Terms and Conditions

Event

  1. The Organiser reserves the right, with reasonable cause, to refuse entry or to remove any person who in the opinion of the Organiser causes a disturbance or refuses to comply with reasonable requests made by the Organiser. 
  2. All guests under the age of 18 must be accompanied by a guardian or responsible adult. 
  3. You may be asked to verify your age upon entry.  
  4. While this event is for all ages, it is licensed. No food, alcohol or beverage is permitted to be brought to the event and organisers have your consent to search all bags upon your entry. 
  5. This event is strictly no-smoking.  

Ticketing 

  1. Your ticket is bound to the entry time set out on your ticket. 
  2. From 5pm, tickets will become available to walk-in non-ticket holders. Your pre-registered ticket will remain valid after 5pm, however, your ticket will no longer grant you priority. From 5pm it will be necessary for you to wait in line with others.  Your entry will only be granted if the capacity of the event has not yet been reached.  
  3. The capacity for the venue is set by the event staff and security for safety purposes.
  4. Tickets must be retained whilst at the event.
  5. Ticket holders should only hold a ticket in their name. 
  6. All tickets are subject to the conditions noted thereon.  

Event Changes & Cancellation 

  1. Ticket holders acknowledge that the Organiser, the Event and your participation at the Event, are subject to Orange City Council’s policies, as well as laws, government restrictions, and enforceable directives, which vary from time to time. You agree to comply with the above conditions and acknowledge that they may affect whether and how the Event will be run and/or your participation at the Event.   
  2. The Organiser reserves the right change any aspect of the Event, including to cancel the Event, add, withdraw, reschedule or substitute artists or speakers and/or vary advertised programs, prices, venues (including digital platforms) and seating (including to reduce the number of persons who may attend the Event). The Organiser will endeavour to provide you with notice of such changes.   
  3. If the Organiser cancels the Event, to the extent permitted by law, the Organiser excludes all liability arising out of, or in connection with, the Organiser cancelling the Event. 
  4. If after registration you are no longer able to attend the Event, the Organiser asks that you advise the Organiser in writing or cancel your ticket as soon as practicable. 
  5. In the event of poor weather, this event will move to the Naylor Pavilion at the Orange Showground. The capacity of this venue will be significantly reduced and therefore your ticket may no longer guarantee you entry. Entry will be granted on a first-come, first-served basis. As advised above between 3pm and 5pm priority will be given to those who have a registered ticket.  

Release 

  1. Views expressed by artists or speakers participating in, or sponsoring, the Event are not necessarily those of the Organiser. 
  2. You participate in the Event at your own risk. The Organiser or its employees, contractors or agents (), are not liable, to the extent permitted by law, for any losses, damages, expenses, injuries or other claims in relation to your participation or attendance at the Event,  
  3. The Organiser’s services come with guarantees that cannot be excluded under the Australian Consumer Law.   

Participant Behaviour & Damage 

  1. The Organiser reserves the right to prohibit you from entering the Event venue and/or to remove you from the Event if, in the organisers opinion, you breach any of these terms and conditions or your behaviour is deemed dangerous, inappropriate or disruptive.   
  2. If your actions result in damage to, or the loss of, any property, you must pay the Organiser the full remediation cost.   
  3. You agree to comply with all notices displayed at the Events.  
  4. You are not authorised to use any recording devices. 
  5. Unless authorised by the Organiser in writing, you must not conduct any commercial, political, soliciting, promotional, surveying, canvassing or demonstration activity at the event, nor collect contributions or distribute any material. 

Privacy & Personal Information 

  1. All personal information will be collected in accordance with all relevant privacy laws in force from time to time including the Privacy and Personal Information Protection Act 1998 (NSW) as well as the Orange City Council Privacy Policy  You consent to the Organiser collecting, storing, using and disclosing your personal information, including all of the information contained in the registration form, for the purposes of administering and managing the Event and future Events, including updating your record in the Organiser’s database. 
  2. The Organiser may disclose your name, organisation and contact details to other organisers and/or partners involved in the Event (if any) and may use your personal information to contact you for purposes relating to the Event or to promote future events.   
  3. The supply of your personal information is voluntary; however, if you do not provide it to the Organiser, you may not be able to purchase, register for or participate in the Event.   
  4. You have a right to access your personal information held by Orange City Council. You can also request amendments to that information if you believe that it is incorrect or make complaints about the information handling practices of Orange City Council or breaches of your privacy by Orange City Council. The information you provide will not be retained for longer than necessary and will be managed in accordance with Orange City Council’s Privacy Policy.

Use of Your Image 

  1. You acknowledge that the Event may be recorded or photographed. You consent to the Organiser and third parties permitted by the Organiser taking photographs and audio/visual recordings of you throughout your participation in the Event and agree that the Organiser may use the photos or recordings in their original or edited form in broadcasting or communicating the Event to the public and for future promotional and marketing purposes without further notice or compensation to you.   
  2. If you are invited to submit pre-recorded content for an Event, you grant the Organiser an irrevocable, free, worldwide, sublicensable licence to use, reproduce, adapt, modify and communicate to the public that content. You agree that the Organiser may use that content in its original or edited form, including at or in relation to the Event, broadcasting or communicating the Event to the public, on its social media pages, and for any purpose, including future promotional and marketing purposes without further notice or compensation to you. 
  3. In providing your consent, you release and discharge the Organiser, its staff and its agents from any and all loss, damage, expense or claims that you may suffer or incur by the use by the Organiser or any third party permitted by the Organiser of the photographs and recordings and/or the content of the same photographs and recordings.  

Health and Safety 

  1. Children must be supervised at all times by a responsible Guardian.
  2. If you are attending the event as part of a group, as the primary ticket purchaser, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government, including the Department of Health, for the purposes of contact tracing, you must:
    2.1. make the contact details of your group available to the Government (if you have the consent of each group member to do so); or
    2.2. contact each member of your group, and request that they provide their contact details to the Government directly. 
  3. If at the time of the event, either you, or any other members of your group are feeling unwell you should not attend the Event.
